Kerala HC Division Bench Verdict May Come At Any Time

Dear Candidates,
               There is no hearing today. The judges have kept the judgment in abeyance so that they can prepare it as it is not a single page you know. As it is already mentioned in the previous post that  this is a writ petition [civil ], the verdict may be informed to appellant and respondent and not announced in the court.
                Keep your fingers crossed. We will definitely win.

Judgement Applicable To All

Friends,
           Please be comfortable and relaxed as and if the verdict of Kerala HC Division Bench favours us, it will be applicable to non-petitioners too. As many candidates are asking such a question regarding applicability and universality of the verdict, it is already ensured in the previous judgement and matter. Let's look into the history: 
                     'ONE OF THE ADVOCATES OF THE PETITIONERS APPEALED TO SUPREME COURT THAT AS THE VERDICT IS GIVEN UNDER THE ARTICLE 32 OF THE CONSTITUTION BY KERALA HIGH COURT SINGLE BENCH IN UGC NET EXAM JUNE 2012, IT SHOULD BE MADE APPLICABLE TO OTHER NON-PETITIONERS TOO. SO THE SUPREME COURT ORDERED UGC TO MAKE THE VERDICT APPLICABLE TO ALL INCLUDING BOTH PETITIONERS AND NON-PETITIONERS.'
             So don't bother. Just pray. Good luck.

Kerala HC Division Bench: JUDGEMENT DAY On 25th March

Friends,
         The Hearings from both sides in Kerala HC Division Bench are over. The counter point session will be on 25th March and the final verdict will be declared on that day too. Hence, 25th March will prove JUDGEMENT DAY for us. The verdict will make all the petitions in front of all High Court Single Bench all over India pointless. All the hearings in all courts are awaiting the verdict of Kerala HC Division Bench.  MAY GOD BLESS US.
         Meanwhile, we have got victory in Banglore High Court too.
         Secondly, the hearing of Nagpur High Court is postponed to on 1st April.

Kerala HC Division Bench: Leading To Climax

Brothers,
            UGC demanded the next hearing which is on 18th March. UGC had also taken many hearings in Single Bench Court and now repeating it now  but you know it was in vain. In the court, the Division Bench asked UGC why the verdict of Single Bench was  not applicable. Now the process is leading to the verdict or climax as UGC has not some solid defence against the point.
            According to the many advocates, the verdict of Division Bench is the most important. If it goes in favour of us, all the petitions in Single Bench Court from all over India become pointless. All Single Benches will follow Division Bench. It will be a great victory.
           Secondly,  a case in Nagpur Court is in front of  Single Bench, not Division Bench.
           Fourthly, it is undoubtedly crystal clear that we will win in Kerala High Court Division Bench but what is important that whether UGC will go into Supreme Court. In my opinion Supreme Court may not accept its filing as SC has already upheld the verdict of Single Bench High Court verdict. 
           Now, the hearings of Kerala HC Division Bench and Nagpur High Court are on 18th March, 2013.

UGC Committee To Examine Fulfillment Of NET exam ose

Brothers,
             According to Times Of India, the University Grants Commission has set up a new committee to examine whether the National Eligibility Test (NET) is actually effective in its role as a gatekeeper for all those who seek to teach in the Indian university system. Actually, the wonder is not so much that the authority of the NET has been supreme ever since it was instituted in the 1980s, but that this has been so despite the many second thoughts that the UGC itself has had about it in the interim.
             In 1993, UGC decided to give PhD and MPhil degree-holders exemption from the NET, because these are the highest degrees in academics, and thereby denote lofty standards in and of themselves. In 2002, the blanket exemption was withdrawn. In 2006, a concerned committee recommended scrapping the NET, but all that was once again scrapped was the requirement for PhDs and MPhils to take the NET. In 2009, MPhils lost the exemption. In 2012, qualifying scores were changed across general, SC/ST and OBC categories after the NET results were published!
It's education that has been the casualty of UGC's whimsy. It has been pushing for inter-disciplinary courses for students even while promoting a multiple-choice exam for teachers. With critical thinking at one end and rote cramming on the other, UGC has basically set up an unworkable equation. Universities set up as centres of excellence need to be autonomous, and an essential component of that has to be autonomy in selecting their teachers. Using the NET as gatekeeper relies on a centralised, colonial model of university education that is obsolete. So let NET retreat into limbo. And shed no tears for the death of its 'common national yardstick', for higher education is actually about creating excellence, also known as distinction.
             As u know that there is a general body meeting of UGC, on 11 th March, 2013, some students are about to protest.

Next Hearing of Nagpur High Court on 18th March

Friends,
           The NET/JRF aspirants have challenged the supplementary results of their examination conducted by University Grants Commission (UGC) on June 24 last year. There was much hue and cry over tough results declared by UGC on September 18 leading to declaration of supplementary results on November 12 by applying new eligibility criteria.         
         A high court division bench of justices Avinash Lavande and Arun Chaudhari on Wednesday directed the UGC to reply before March 18 which was also fixed as next date of hearing.

Advocate's Opinion

Dear Friends,
                        As some candidates have been discussing the issue, especially date on date of Kerala High Court Division Bench, with the senior advocates, the gut feeling of some advocates is that the hearing on 4th March will be final and the verdict will be informed to both petitioners and respondents. As it is already happened in the Kerala High Court Single Bench, the verdict will not be declared in the court but will be informed to both due to writ petition. Keep fingers crossed on 4th March i.e. on Monday.
                      Surprisingly, the hearing of Nagpur High Court is also scheduled on 4th March. So, UGC may receive double doses.
