Part E – Case study : A case study of a commerce student
The following is a case study of commerce student who attended June 2012 NET exam for Lectureship only from Kerala
1. Analysis of commerce syllabus - There were no change announced in the syllabus in June 2012 or even after it. So the syllabus in which December 2011 exam is continued in June 2012 also.

 



It is clear that Income tax is one of the options in Paper III, which is not compulsory and no-coincidence like other option which is also a part of Paper II syllabus.

 

               The questions in paper III was not proportional. The 5 questions from Tax, which was a separate option, no coinciding with other options, were just unexpected.   
            Income tax is a separate part and in most of universities, it is one of the optional papers for MCom. International business, Marketing, Finance, HRM etc are also optional but it comes in the second paper syllabus of UGC and so need not separate study of that subject. For students who opted Marketing or others as their elective subject for M. Com, he needs a separate preparation of income tax. In many of the universities taxation is also an optional for B.com degree courses and so only the students who took taxation as their optional subject will be familiar on that subject.
              UGC had to mention the change in syllabus of Paper III before June exam. They must have clearly state questions from all optional part of earlier syllabus will be included without any option for paper III. This may help students to prepare taxation and attend the five questions of taxation.

4. Before climax:
He attended June 2011 descriptive session of exam without preparation, after an interval of 5 years completing his PG. He was working as a computer instructor and not had freshened his “commerce” before this. The attending of exam was just to evaluate him how competent he is without single reading a book of commerce for 5 years. The quality arguers please look at the results of that candidate in the exams. This is not a single story of victims, but many of the victims will have the same or equivalent story.


 

             He got 64 in Paper I, 60 in II and so Paper III evaluated. As he was an OBC, he needed to score 80 Marks in Paper III, and just short of 4 marks he fell.
5. The climax

                He attended the June 2012, was confident to win it easily with minimum preparation as 35, 35 and 45 was an achievable target for him without very huge preparation. He has noticed the however clause in the notification which make the authority to take the power of changing criteria. But in a normal course of action, no one think it will be as high as aggregate 65% for general and 60% for OBC etc because in any exam scoring 60% is considered as getting First class. So a normal 5 to 10% increase is only expected
                His option for MCom was financial management and for BCom, it was Hotel, Travel & Tourism management for which Taxation was not part of course. For descriptive NET exam, he opted marketing or HRM according to the relative easy level in question paper. He never prepared the books of taxation because it is optional and realized that to score the mentioned marks or just 5% above mentioned score, it is not necessary to prepare such a high content subject.
              The cut off for June 2012, published 3 months after supplementary result revealed that For commerce lectureship only candidate in OBC NCL category needed to score 59.43% aggregate.
               The score before having a good understanding between UGC and him because of not providing clear cut procedure of cut off or % to be scored -

He scored 198 marks and 56.57% aggregate……….



             Only 5 right answers may provide him 10 marks and eligibility. The omitted 5 questions from the subject taxation played a vital role in reducing this. If UGC have mentioned clearly about the syllabus, the story of this man may be a different one.
             After attending June 2012 NET exam, he was confident of passing. The risky performance in Paper III brought some doubts in his mind- Yet was sure on getting more than minimum prescribed in Notification. On 18th August 2012, when published the provisional answer keys, he became some more relieved. Friends and colleagues asked for sweets and celebration- The anxiety made him not to celebrate. On 18th September 2012, he cannot find his register number among result pdf like many of his colleagues. He got no idea of what had happened. On the very next day he knew aggregate 60% was required to pass for his category. It was unexpected and shocking. After getting mark sheet he realized that only 6 more right answers would have bring him 60% and victory.
                 It was really injustice. A shooter atleast need to know the point where to he shot before shooting. Otherwise he will miss the target. “You carry on shooting- after you shot bullets we will decide the point which you ought to be shot” – The decision of UGC was like this.
              All the colleagues were in an agitation mood and decided to approach legal help through court against this injustice. Though he hated the system, his mind was challenging. He was a keralite and the only opportunity by NET certificate for people who have low finance is the posts in government colleges. (The govt aided colleges for which salary is paid by government at UGC scale, but the appointment is by the management and now need Rs 40 lac to 50 lac, and is not affordable by candidates like him.) The PSC commerce Lecturer list was valid up to September 2013 and normally a new fresh notification could be expected in June 2013 or later. So he decided to crack it in December 2012 and if qualified, the notification will be ready- That was his calculation and so not joined in petition and started fight with taxation books.
              Suddenly on December 2012 starting, a fresh notification was invited by PSC including commerce- The next could be expected only after 2018 and will have age limit threat. So he joined in petition and relieved by Kerala High Court Order. He applied for post with the NET June 2012.
                Experience is the best teacher. Once he was made fool by UGC by asking 60% aggregate after his role is completed. So this time he was well aware of the fact that even 60% aggregate will not be a safe point for victory



This is after realizing…………
             The cut off for commerce lectureship in December 2012 was aggregate 54.86% for OBC category and JRF cut off for OBC was aggregate 63.43%. And he scored exactly 65.14% aggregate. More than that of JRF cut off for his category. Lectureship cut off for general category was aggregate 60.57% …….!
               This is a living proof against UGC. If they had atleast announced as “Final qualifying criteria will be +10 to 20% of minimum and will be decided with result” the candidates like him can prepare well for achieving that. UGC says it is first time the whole objective mode and so could not calculate it before exam. If this argument is approved, OK. They can’t say the cut off will be 65% aggregate in advance without knowing how will the all students perform. But they could still announce the top7% basis and it is a practically viable and announcable criteria for an exam which cut off could not be predicted in a before exam situation. If top7% was announced in notification before exam, we can have good understanding that scoring minimum or something more than minimum is not sufficient and we should compete for including in top7%. But they don’t do that.

               In boyhood days we had a habit of throwing stones to mango tree for mangoes. A boy should know where is mango, in which branch it is placed and should aim his throw. UGC has shown us some mangoes in a tree and asked us to throw. We threw and made mangoes fallen in the ground. But UGC said- You are not qualified because you have to make a mango fallen from a higher branch.
            Many of victims have passed in December or just one or two points away from victory. This is the proof for whether the June 2012 notification was clear and well mentioned the criteria or it was cunningly and brutally hide by a however statement.
6. Anti- climax
            Passing NET is good and fruitful. But in Kerala, read the stated opportunities. By a NET certificate a student has mainly 3 opportunities
1. Appointment by PSC in government colleges for which PSC invites application in the interval of 4 to 5 years. After inviting application- (the all qualification including NET should be made before the last date of application)- the exam, short listing, interview, ranked listing, sending advice memo by PSC and appointment order by collegiate education department- It is a long process consuming atleast 2 years. Now Kerala government has extended the validity of ranked lists upto 4 and half years. Remember PSC has last notified for posts in December 2012 and the last date of application was Jan 5, 2013. So the NET qualified before 5th January will be only able to sent valid application for exam. The December result came on March 26, 2013 and so who passed in December 2012 is not eligible to apply. The favorable court order by KHC was a safeguard for application and now after Supreme Court Order, it and the application became invalid. The exam is not still announced and PSC is going to verify certificate in the October 2013 and so application with KHC order is going to be rejected. The next PSC notification will be atleast after 5 years in 2018 or 2019 and age limit for application is a threat.
2. Second opportunity is government aided colleges. There salary for staff will be provided by government in UGC scale, but the appointment is controlled by Private management. Now the market rate for a post is Rs 40 lac to 50 lac. Students having high financial background will only benefit.
3. Third opportunity is in unaided self financing colleges. There is no job security and salary is only between Rs 5000 to 12 000, and should sign in pay register with UGC scale.
In short our character, Mr. Niyas has no use for his NET December 2012 certificate. But have a message to all. It is easy to crack NET. If your age and situation allows and you are confident of your future opportunities try to crack it in December 2013, like a sweet revenge to UGC and blind law interpreters if you have already not cracked or may be won in June 2013.
Thanks for all. His pass in December 2012 has no use, but he never considers the cause of his pass is his own ability. He is thankful to all especially for all commerce candidates appeared in December 2012 in OBC NCL category. He is being passed and involved in top15% only because the other omitted lower 85% of candidates scored minimum. If half of them have not scored minimum, the cut off may raise and only half of the present passed may have passed. And even who attended the exam in commerce OBC NCL category and failed to score minimum, internally helped his victory. May God bless you all.
