After the last long debate and pleading by both sides, the judges kept their judgement reserved today. The court hearing lasted for more than one and half hour.
What is worrisome now is that when the verdict of judgement is kept in abeyance, the judges have some differences in opinion or both the parties . . . . . . . . . . . . . . . . . . . . . . . . . . . . .

Let me throw some light on why the judgement is reserved.
Q : What does it mean that the court has reserved its judgment?
A : When a court reserves the judgment, it means the matter has been kept in abeyance for a while. This is done after all the parties have completed their arguments and all the written submissions have been filed in the court.
Q: Why do judges reserve a judgment?
A : The judges reserve a judgment so they can write a judgment. One must understand that a judgment is not a single page order of few lines, the judgment contains the summery of arguments of both the parties, the law of the land, previous judgments on the issue, conclusion and the reasons for arriving on that conclusion. Judges need time to refresh in their memory, the arguments of each party, do research by reading previous judgments and judgments on similar issues in other countries and finally think about the reasons for arriving on a particular conclusion. This entire exercise is very laborious and time consuming.
Q : What is the normal time frame in which a judgment should ideally be delivered?
A : There is no fixed time frame for the judges to write judgments but six months is considered to be a reasonable time for passing a judgment. If a judge keeps a judgment reserved for more than six months, any of the party can mention to the Chief Justice about this.
Q : What happens to a reserved judgment if the judge retires?
A : If anything like this happens, the new bench will hear the matter afresh. A judge can not sign/pronounce a judgment after he retires.
Q : Is it necessary for a judge to reserve judgment in every case?
A : No! Its not at all necessary for a judge to reserve judgment in all the cases. Generally the court reserves the judgments in cases of extreme public importance, cases which will have greater impact on the polity of India, cases in which the courts are laying down some new law etc. In many cases, judges deliver the same day the arguments are complete.

i want to file a case in supreme court regarding this case and plead for stopping all the interviews regarding astt. professor post opportunity in delhi university till the final judgement came so that we all who are victim of ugc apathy can get a fair chance as well , otherwise its a double injustice for us simply bcoz ugc is at fault. any one who is interested plz do call me my no. is 9811391935....vikram sharma....

We have to file petition for stay order for interview process till the final judgment came... Bcz colleges will not proceed our application even for screening process .. ReplyDeleteHere I would to remind you about the Indian Judiciary, just try to see some pending cases, many time it has been happened judgments has been made after 10-15 years. there is also need to see the judgments which has gone against the system (government), it may be in your finger tip. Just I would request you to file a case or PIL where every recent recruitment on the post of Assistant Prof. should be stayed till the time of Justice delivered because you are losing the opportunity.
Here, I would also like to say thanks to Yuvi for his hard and smart work. Here we are fighting against the system. I know you are going to win.

ReplyDeletedear friends i think u should understand the nature of indian judiciary. if u get win in this case ugc will definately creat another burden for us and when fainally we will taste the success it will take 4 - 5 years of our precious life. im not pecimist but i m practical. so my friends i beg of u please forget anything like ugc net june 2012 for a while and start take preparation for net dec 2013 bcz this is the last exam on mcq. i m doing so please u do the sMe bcz we donot have any othrer option . or u can do ph.d. in a new curriculam. thanking u hope u il do the best for ur life. regards rajib.

i know that we will win. but my friends this process il take time. ugc never leave this easily . thats why i said not to wait for too long . just to believe in ourselves to give the exam again and by this time we will fight against ugc together.
ReplyDeletei have come to know about the news that dec13 will be last mcq by the vc of calcutta university in a seminar. who is an eminent member of ugc core group.
ugc made mcq bcz there was a lac of examiners to see our answer sheets. to make their work easy and also there was only 2% students were qualifing net to increase this number ugc made mcq. but now ugc facing many problems and one group of members of ugc are against this mcq and now they r in a process of find a new format of net exam. i hope i make it clear to u guys.......
