Judgment on SLP and Counter Opinion : Part Third : The Key To Success

            This is the third and last part of the important series of articles on SLP judgment. Please

After reading the two articles and watching the whole drama beginning in Kerala, travelling through Nagpur and ending at Delhi, the quintessence of the whole issue is UGC may
impose any qualifying criteria but it must notify before the examination begins.
If you read the ‘Scheme of Test’ only from three notifications of three consecutive examinations namely December 2011, June 2012 and December 2012 and compare them with each other, you will clearly understand that

A]        UGC stuck with what they mentioned in the notification of December 2011
B]        UGC changed and imposed new final qualifying criteria without informing through notification to students
C[        UGC deliberately elaborated the ‘scheme of test’ in the notification of December 2012, seeing the objections taken by students by knocking the door of High Court, and UGC improved the mistakes and met the loopholes remained in the previous notification through December 2012 notification.
What is needed now is to present these facts by comparing three notifications simply in front of judges through Review Petition. Click on the three notifications if you want to refer:




Shocking:
            When the judgment on Special Leave Petition arrived, the persons who were among the most shocked ones were the senior lawyers. It means that they also think and feel what we do.
Review Petition:
            Some candidates are preparing to file the review petition. The series of articles may play an important role in rejecting the Special Leave Petition filed by UGC if it is taken into consideration. If someone adds additional points besides the above, it will be bonus for us.
Need to be Optimistic:
            If UGC had lost the case or had received the rejection of their SLP, they would have filed Review Petition. If we have an option and all the doors are not closed, the sanity lies in filing Review Petition. Otherwise, if that option were not open, then ………………………
